Performance Motors Short-Term Rental Platform Promotional Campaign Terms & Conditions (“T&Cs”)

These T&Cs apply to the promotional campaign, which comprises (i) the offer of a promotional gift and (ii) a lucky draw (collectively, the “Campaign”) conducted by Performance Motors Limited (“PML”), in relation to selected BMW vehicles made available for short-term rental on the platform (“Short-Term Rental Platform”) of selected partner(s) (“Partner”) of PML. By scanning the car QR code located in a participating BMW vehicle and submitting the interest registration form and/or otherwise participating in the Campaign, you acknowledge that you have read, understood, and agreed to these T&Cs.

1. ELIGIBILITY

  • 1.1 The Campaign is open to individuals who (a) are customers of the Partner with a valid and verifiable Booking ID for a booking of a participating BMW vehicle made on the Short-Term Rental Platform during the Campaign Period; (b) scan the QR code located in a participating BMW vehicle; and (c) submit the required information via the interest registration form within the Campaign Period. PML reserves the right to determine the eligibility of any participant at its sole discretion.

2. CAMPAIGN PERIOD

  • 2.1 The Campaign shall run from 16 March 2026 until 31 December 2026, or such earlier date as may be determined by PML at its sole discretion (the “Campaign Period”).

3. PROMOTIONAL GIFT

  • 3.1 Subject to Clause 3.3, each eligible participant shall receive a gift of a cashcard with a stored value of S$5, subject to availability and while stocks last.
  • 3.2 PML reserves the right at its sole discretion to substitute any gift with any other item without prior notice.
  • 3.3 The gift is strictly available for collection only upon the eligible participant’s attendance at a test drive arranged during the Campaign Period, and shall be collected at the time of such test drive (or at such other time and place as PML may determine). For verification purposes, the participant shall be required to present a valid identification document (e.g. Singpass or physical NRIC / FIN) when collecting the gift.
  • 3.4 For the avoidance of doubt, each eligible participant shall be limited to a maximum of one (1) gift for the entire Campaign Period, and multiple bookings by the same eligible participant during the Campaign Period will not entitle the participant to multiple gifts.

4. LUCKY DRAW ENTRIES

  • 4.1 Each eligible participant will be entitled to one (1) lucky draw entry in the lucky draw ("Lucky Draw Entry").
  • 4.2 For the avoidance of doubt, each eligible participant shall be limited to a maximum of one (1) Lucky Draw Entry for the entire Campaign Period, and multiple bookings by the same eligible participant during the Campaign Period will not result in additional Lucky Draw Entries.

5. LUCKY DRAW FREQUENCY

  • 5.1 A draw would be conducted after the end of each Entry Collection Period (as defined in Clause 8) during the Campaign Period.

6. VALIDITY OF LUCKY DRAW ENTRIES

  • 6.1 Lucky Draw Entries submitted in a given month shall be eligible only for the monthly draw for the immediately subsequent month, and shall not be carried forward to or included in any other monthly draw.

7. PRIZES AND WINNER SELECTION

  • 7.1 Prizes:
  • 7.1.1 The prizes for the monthly draws will consist of Official BMW Merchandise, as determined by PML at its sole discretion.
  • 7.1.2 The number of prizes shall also be determined by PML in its sole discretion.
  • 7.1.3 PML reserves the right at its sole discretion to substitute the prizes for the monthly draws with any other item without prior notice.
  • 7.2 Winner Selection Process: Winners for each monthly draw will be selected randomly from all eligible Lucky Draw Entries received for that draw.
  • 7.3 Random Draw Method: A computerised random selection tool will be used to ensure that all Lucky Draw Entries have an equal chance of being selected. The random selection tool will be independently audited to ensure fairness and transparency.

  • 8.1 Winners will be notified via email or phone or any other method of communication deemed fit by PML within 14 working days after each draw.

9. PRIZE COLLECTION

  • 9.1 Winners must collect their prizes within 7 days after notification.
  • 9.2 In the event that a prize is unclaimed within 7 days, PML has the right at its sole discretion to deal with it as it deems fit, including but not limited to awarding it to a new winner or forfeiting the prize.
  • 9.3 For verification purposes, the winner shall be required to present a valid identification document (e.g. Singpass or physical NRIC / FIN) when claiming the prize. If a winner requires a representative to claim the prize on his/her behalf, the winner must ensure that the representative provides a letter of authorisation issued by the winner, along with a copy of the winner’s and the representative’s valid identification document.

10. GENERAL TERMS

  • 10.1 PML reserves the right at its sole discretion to disqualify any participant who violates these T&Cs or engages in fraudulent activity or otherwise as it deems fit.
  • 10.2 The decision of PML in determining the lucky draw winners is final and binding.
  • 10.3 By participating in the Campaign, each winner consents to and authorises PML (and its related corporations, agents and service providers) to use the winner’s name and/or image (including photograph and likeness), and such other particulars as may be reasonably required, for advertising, publicity and promotional purposes in any media, without further notice to or compensation for the winner.
  • 10.4 Participants are responsible for ensuring that all information provided in the interest registration form (including but not limited to personal information and Booking ID details) is accurate, complete and up to date. If any information is inaccurate, incomplete, false or misleading, PML may (without prejudice to its other rights) disqualify the relevant participant and/or void the relevant Lucky Draw Entry(ies) and/or conduct a re-draw of the relevant monthly draw(s). PML also reserves the right to forfeit any gift and/or prize and require its return where it has already been issued or delivered.

11. PRIVACY

  • By participating in the Campaign and/or claiming any gift and/or prize, each participant (including any winner) consents to PML collecting, using, disclosing and otherwise processing the participant’s name and other personal data, including but not limited to personal identification information, contact details, image and voice, for purposes including but not limited to administering and conducting the Campaign, verification of eligibility and identity, contacting participants and/or winners, gift and/or prize fulfilment, and marketing and publicity purposes in connection with the Campaign, BMW brand and vehicles, and PML. Without prejudice to the generality of the foregoing, winners acknowledge that PML may use their name and/or image for advertising, publicity and promotional purposes in accordance with Clause 10.3. Where a participant affirmatively opts in via any consent mechanism made available in connection with the Campaign, the participant further consents to receiving direct marketing and promotional communications from PML (and its related corporations, agents and service providers) via such channels as may be selected (including email, SMS, telephone and messaging platforms). All personal data will be handled in accordance with PML’s privacy policy (https://www.pml-bmw.com.sg/site/privacy-policy/).

12. MODIFICATION OF TERMS

  • PML reserves the right, at its sole discretion, to amend, vary, supplement and/or withdraw these T&Cs at any time without prior notice. Any such amendment, variation, supplement or withdrawal shall take effect from the date of publication of the updated T&Cs (or such other date as may be specified by PML).

13. NON-TRANSFERABILITY / NON-EXCHANGEABILITY OF LUCKY DRAW ENTRIES AND GIFTS / PRIZES

  • 13.1 The eligibility for the Campaign and Lucky Draw Entries cannot be transferred to another individual.
  • 13.2 Gifts and prizes are non-transferable, non-exchangeable and not redeemable for cash.

14. LIABILITY

  • 14.1 To the fullest extent permitted by law, PML and each of its officers, employees, representatives and agents shall not be liable for any loss, damage, cost or expense (including any personal injury and/or property damage) suffered or incurred by any participant and/or winner arising out of or in connection with the Campaign and/or the lucky draw, including (without limitation) participation in the Campaign, submission of any Lucky Draw Entry, selection of winners, and/or notification, collection, redemption and/or use of any gift and/or prize.
  • 14.2 Participants and winners agree to indemnify, defend and hold harmless PML and its officers, employees, representatives and agents from and against any and all claims, demands, actions, proceedings, liabilities, losses, damages, costs and expenses (including legal costs) of whatsoever nature arising out of or in connection with the Campaign and/or the lucky draw and/or the participant’s or winner’s acts or omissions.

15. GOVERNING LAW

  • 15.1 These T&Cs are governed by and shall be construed in accordance with Singapore law.
  • 15.2 Any dispute, controversy or claim arising out of or in connection with these T&Cs and/or the Campaign shall be subject to the exclusive jurisdiction of the courts of Singapore.
